These Hardware and Software Terms explain our policies for hardware purchases, software purchases, hardware returns, warranties, leasing, and equipment responsibilities.

Hardware Purchase Policy

All hardware purchases are considered final once the order has been confirmed. After confirmation, hardware orders cannot be cancelled, refunded, or exchanged unless the product qualifies for replacement under the manufacturer’s warranty.

If a handset or device is defective, it may be eligible for replacement during the manufacturer’s warranty period. Warranty replacement approval depends on the product condition, warranty coverage, and manufacturer guidelines.


Return Merchandise Authorization Policy

Before returning any hardware, customers must first request a Return Merchandise Authorization, also known as an RMA.

Please do not ship any hardware back without receiving an RMA number and return confirmation from Blue Sky VoIP Solutions.

Returned products must meet the following requirements:

  • The product must still be within the manufacturer’s warranty period.
  • All original parts, cables, cords, connectors, power supplies, and accessories must be included.
  • The product must be safely packed in a proper shipping box.
  • The RMA number must be clearly visible on the outside of the package.
  • The product must be returned within 10 business days after receiving the RMA number.
  • Customers are responsible for return shipping costs.
  • Replacement shipping may be provided at no additional cost, depending on the warranty situation.

If any required parts or accessories are missing, additional fees may apply.


Software Purchase Policy

All software purchases are final sale. This includes, but is not limited to, softphone licenses, activation keys, digital software licenses, and any other software-related purchases.

Once a software license or activation key has been issued, it cannot be cancelled, refunded, returned, or exchanged.


Hardware Leasing Policy

If hardware is leased through Blue Sky VoIP Solutions, the customer agrees to pay the recurring monthly charges listed in the applicable service agreement or equipment agreement.

The customer is responsible for keeping all leased hardware in good condition during the full term of service. Any damage, loss, theft, or misuse of leased equipment may result in repair or replacement charges.

If services are cancelled, all leased hardware and accessories must be returned within 30 days after cancellation, unless otherwise agreed in writing.

The customer is responsible for return shipping costs related to leased equipment.

Leased hardware must be returned in good working condition, except for normal wear and tear.


Equipment Ownership

Any leased equipment remains the property of Blue Sky VoIP Solutions or its leasing partner unless otherwise stated in writing.

Customers may not sell, transfer, modify, pledge, sublease, or assign leased equipment without written permission.

The equipment must remain at the approved service location unless Blue Sky VoIP Solutions gives written approval to move it.


Customer Responsibility for Equipment

Customers are responsible for the proper use, care, and protection of all purchased or leased hardware.

Customers agree to:

  • Use equipment only for its intended purpose.
  • Keep equipment in good working condition.
  • Protect equipment from damage, loss, misuse, theft, or unauthorized changes.
  • Follow manufacturer instructions and service guidelines.
  • Notify Blue Sky VoIP Solutions promptly if equipment is damaged, lost, stolen, or not working properly.

Blue Sky VoIP Solutions is not responsible for damage caused by misuse, improper installation, unauthorized changes, power issues, network issues, or customer negligence.


Warranty Disclaimer

Hardware may include manufacturer warranty coverage. Any warranty claims are subject to the manufacturer’s warranty terms and approval process.

Blue Sky VoIP Solutions does not provide any additional warranty unless specifically stated in writing.

Blue Sky VoIP Solutions does not guarantee that hardware or software will be suitable for every business need, network condition, or technical environment.

To the fullest extent permitted by law, Blue Sky VoIP Solutions is not responsible for indirect, incidental, special, or consequential damages, including business interruption, lost revenue, service interruption, or loss of data.


Risk of Loss

The customer is responsible for any loss, theft, damage, or destruction of equipment after delivery, installation, or acceptance.

For leased equipment, the customer remains responsible until the equipment is returned and received by Blue Sky VoIP Solutions or its leasing partner.

If leased equipment is lost, stolen, destroyed, or damaged beyond repair, the customer may be responsible for replacement costs.


Insurance

For leased hardware, Blue Sky VoIP Solutions may require the customer to maintain insurance coverage for the equipment during the lease term.

Insurance may need to cover loss, theft, damage, fire, and other risks.

If insurance is required, the customer must provide proof of coverage when requested.


Maintenance and Repairs

Customers are responsible for maintaining equipment in good condition.

For leased equipment, customers must not make unauthorized repairs, modifications, or alterations.

If equipment needs service or replacement, customers should contact Blue Sky VoIP Solutions before taking further action.

Unauthorized repairs, changes, or modifications may void warranty coverage or result in additional charges.


Return of Leased Equipment

At the end of the lease or service term, the customer must return all leased equipment and accessories.

Returned equipment must include:

  • Phones or devices
  • Power supplies
  • Cables
  • Connectors
  • Handsets
  • Stands
  • Any other included accessories

The equipment must be packed safely and returned to the location provided by Blue Sky VoIP Solutions.

If the equipment is not returned, is returned damaged, or is missing accessories, the customer may be charged additional fees.


Late Payments and Default

Customers are responsible for paying all service, hardware, software, and leasing charges on time.

If payment is not received by the due date, late fees or service interruptions may apply.

Failure to pay required charges, return leased equipment, or follow these terms may be considered a default.

In the event of default, Blue Sky VoIP Solutions may take action to recover unpaid amounts, recover equipment, suspend services, or apply other remedies allowed by law or agreement.


Taxes and Additional Charges

Customers are responsible for any applicable taxes, fees, shipping charges, installation fees, regulatory fees, or other charges related to hardware, software, leasing, or services.

These charges may vary based on the customer’s location, selected services, and applicable laws.


Limitation of Liability

Blue Sky VoIP Solutions will not be liable for indirect, incidental, special, or consequential damages related to hardware, software, leased equipment, service interruption, or equipment performance.

This includes, but is not limited to:

  • Lost profits
  • Lost business opportunities
  • Service downtime
  • Data loss
  • Communication interruptions
  • Equipment failure caused by third-party providers or manufacturers

Changes to These Terms

Blue Sky VoIP Solutions may update these Hardware and Software Terms from time to time.

Any changes will become effective when posted on the website or provided to the customer.

Customers are encouraged to review these terms regularly.
